1. Acceptance of Terms
These Terms govern your use of OpScout, a software service operated by OSHER MEVIN, INC.
By using OpScout, you agree to these Terms.
2. About OpScout
OpScout is a software monitoring and alert service.
Users configure conditions related to market information, and OpScout monitors those conditions and may notify users when they match.
3. Informational Alerts Only
OpScout alerts communicate information resulting from conditions selected by the user.
OpScout does not execute trades.
4. No Investment Advice
OpScout is not a broker, investment adviser, exchange, custodian, or fiduciary.
Nothing provided by OpScout, including alerts, constitutes a recommendation to buy, sell, hold, write, exercise, or otherwise transact in any security, option, or other financial instrument.
You remain responsible for your own financial decisions and for independently verifying information before acting on it.
5. User-Configured Alerts
You independently select:
- the instruments you monitor;
- the conditions you configure; and
- the notification channels you enable.
The triggering of an alert does not mean that any financial action is advisable.
6. Push and WhatsApp Notifications
OpScout may provide notifications through Push and WhatsApp when selected by the user.
Delivery depends on third-party networks, messaging providers, devices, operating systems, connectivity, and other systems outside OpScout's control.
Notifications may be delayed, duplicated, blocked, or not delivered.
7. Accounts
You are responsible for maintaining accurate account and contact information and for protecting access to your account.
You may not attempt to access another user's account or data without authorization.
8. OpScout Pro and App Store Billing
Certain OpScout features may require an OpScout Pro subscription.
Subscriptions purchased through Apple's App Store are billed and managed by Apple and are subject to Apple's applicable billing and subscription terms.
Available plans, prices, billing periods, and renewal terms are presented before purchase.
9. Cancellation and Account Deletion
App Store subscriptions must be managed or cancelled through Apple.
Deleting an OpScout account does not automatically cancel an App Store subscription.
Deleting an account removes access to the OpScout account and initiates deletion of associated OpScout account data as described in our Data Deletion instructions and Privacy Policy.
10. Service Availability
OpScout may be unavailable, interrupted, inaccurate, or delayed.
You should not rely on OpScout as your sole source of market information or as the only means of monitoring an investment or position.
11. Third-Party Data and Services
OpScout relies on third parties for market information, infrastructure, authentication, notification delivery, application distribution, and other services.
Third-party information or services may be inaccurate, delayed, incomplete, interrupted, or unavailable.
12. Intellectual Property
OpScout, including its software, design, trademarks, and content, is owned by OSHER MEVIN, INC. or its licensors.
These Terms do not transfer ownership rights to you.
13. Acceptable Use
You agree not to:
- use OpScout in violation of applicable law;
- interfere with the operation or security of OpScout;
- attempt unauthorized access to systems, accounts, or data;
- misuse notification or communication functionality; or
- reverse engineer or abuse the service except where applicable law expressly permits it.
14. Disclaimer of Warranties
To the extent permitted by law, OpScout is provided “as is” and “as available,” without warranties of any kind.
15. Limitation of Liability
To the extent permitted by applicable law, OSHER MEVIN, INC. will not be liable for indirect, incidental, special, consequential, or punitive damages, including trading or investment losses arising from use of or inability to use OpScout.
16. Suspension and Termination
We may suspend or terminate access where necessary to enforce these Terms, comply with law, or protect OpScout, its users, or third parties.
You may stop using OpScout at any time.
17. Changes to These Terms
We may update these Terms from time to time.
When we do, we will revise the effective date above.
